In 1984, the Supreme Court ruled that courts should defer to the expertise of agencies like the EPA in interpreting ambiguous policies and regulations. So expert scientists, accountable to elected officials, would make judgement calls on these matters. Now, forty years later, the Supreme Court has upended that standard and given judges the power to decide what these complex and technical rules mean.
